Anti-Bullying Policy

 

Magellan Charter School (MCS) is committed to maintaining a school environment free of bullying and harassing behavior based on race, religion, gender, ethnicity, sexual orientation, disability or any other legally-protected classification. Bullying and harassing behavior by staff, students and volunteers at school or at school-sponsored events is unlawful and is strictly prohibited.

 

EXPECTATIONS

Furthermore, MCS is committed to promoting the worth and dignity of all individuals. To do this, the teachers and staff will establish and maintain an atmosphere in which students can develop attitudes and skills for effective, cooperative living, including respect for individuals; respect for cultural differences; respect for the economic, political, and social rights of others; and respect for the rights of others to seek and maintain differences.

Bullying and harassment are prohibited at the school and during school-related activities between students, employees, volunteers and visitors associated with or under the control of the school. This policy is in addition to Magellan’s Sexual Harassment policy.

 

DEFINITIONS

Bullying includes behaviors or communications, explicit or implicit, by one person or group toward another person or group that intimidate, threaten or otherwise unreasonably place the recipients in fear of harm of person, property or reputation. Bullying can occur in person, through traditional forms of communication, and electronically via such means as e-mail, text messaging, social media, and similar venues. Additionally, bullying can be physical, verbal, relational (isolation, spreading rumors), cyber and sexual.

Harassment is any unwelcome offensive verbal, nonverbal or physical conduct that is sufficiently severe, persistent or pervasive as to significantly affect the conditions of one’s employment or a student’s learning. Harassment includes, but is not limited to the following: abusive jokes, insults, slurs, name-calling, threats, bullying or intimidation, unwelcome sexual advances, or the exchange of benefits for performance of sexual or other favors.

REPORTING PROCEDURES

Any student or any adult (employee, volunteer, or visitor) who believes he/she is a victim of bullying or harassing behavior should immediately inform a trusted teacher, the counselor, the Administrator or a member of the Board of Directors at Magellan. Students are also encouraged to inform his/her parents. Magellan's Bullying, Harassment or Intimidation Reporting Form can be used to assist in investigating such complaints.

A school employee, student or volunteer who has witnessed or has reliable information a student or school employee has been subject to any act of bullying or harassing behavior shall report the incident to the Administrator as soon as possible and within two school days.

Anyone who reports bullying or harassing behavior can do so anonymously; however, formal disciplinary action shall not be taken based solely on an anonymous report.No person shall engage in any act of retaliation against any person who reports an act of harassment or bullying. This policy shall not be used to bring frivolous or malicious complaints.

INVESTIGATION PROCEDURES

All complaints of harassing or bullying behavior made by students shall be promptly and thoroughly investigated by the Administrator or the Administrator’s designee (Investigation Chair).

 

All complaints of harassing or bullying behavior made by employees shall be promptly reported to the Administrator or a member of the Magellan Board of Directors. The investigation shall be conducted by the Administrator and/or a member of the Board of Directors.

 

If the Administrator is involved in the allegation, then the Chair of the Board of Directors will lead the investigation.

 

To investigate the matter the Administrator or Investigation Chair may convene a group, including some or all of the following: the student's teachers, the school counselor, and a member of the Board of Directors, as appropriate. Interviews will be conducted as appropriate. At all times, confidentiality will be maintained as facts are gathered during the investigation.

 

The Administrator or Investigation Chair will communicate, as appropriate, with the student's parents. A confidential report will be prepared and filed. Based upon the outcome of the investigation, appropriate disciplinary action will be taken.

DISCIPLINARY ACTION

 

The actions taken in response to evidence of harassing or bullying behavior should be reasonably calculated to end any harassment or bullying, eliminate a hostile environment if one has been created, and prevent harassment from occurring again. In addition to taking disciplinary action as necessary, the Administrator or other school official shall take appropriate remedial action to address the conduct fully. Violations of this policy shall be considered misconduct and will result in disciplinary action up to and including long-term suspension or expulsion in the case of students and disciplinary action up to and including dismissal in the case of employees.


Nothing in this policy precludes Magellan from taking disciplinary action against a student or employee where the evidence does not establish harassment, but the conduct otherwise fails to satisfy Magellan Charter School's high expectations for appropriate conduct.

 

RETALIATION PROHIBITED

 

The school specifically prohibits reprisal or retaliation against any person who reports an act of bullying and harassment. Such reprisal or retaliation may result in disciplinary action, up to and including dismissal in the case of employees, or up to and including long-term suspension or expulsion in certain cases for students.

 

This policy shall be distributed annually in the Magellan Charter School Student Handbook and the Magellan Charter School Staff Handbook.
